Members of the prosecutor's office and the judiciary nationwide will file an official petition for second-instance arrest to 11 Supreme Court justices (STF) on Monday, the eve of the preemptive habeas corpus trial of former president Lula, sentenced to 12 years and a month in the triplet case. On Wednesday, 4, the ministers analyze the merits of the petition of the PT to await in freedom the appeals against the condemnation in Operation Lava Jato.

On Friday morning, more than 330 prosecutors, prosecutors and judges had already signed the technical note. In Brazil this week, truth competed with fiction to see which would emerge the strangest. Truth, as ever, won. In the real-life part of the drama, a bus convoy carrying former president Luiz Inácio Lula da Silva was shot at while the populist leader was travelling through Brazil’s south, leaving bullet holes but no victims. No culprits have yet been identified in the attack. It came as the firebrand leftist, who has 36 per cent support in polls for Brazil’s presidential elections in October - double his nearest rival - was touring the region in a last-ditch bid to raise public support before a critical court hearing next week. Mr Lula da Silva already virtually has one foot in jail after being found guilty of corruption for receiving favours from a construction company. Under Brazilian law, once a conviction is upheld by an appeals court, a criminal must lodge any further appeals to higher courts from the comfort of his or her prison cell. Having exhausted all possible avenues in the appeals court, Mr Lula da Silva’s last hope is a request to the Supreme Court for habeas corpus, a measure that would allow him to remain free pending further appeals. The Supreme Court is due to hear his case next week. If it decides against him, it could be “tchau querido”, or “bye dear”, for Brazil’s best-known politician, a play on the speaking style of his protégé, former president Dilma Rousseff, which has become a motto for their political opponents. The shooting has raised the heat in what already promises to be a divisive election. Extreme right candidate Jair Bolsonaro, arriving in the same region as the bus convoy, reiterated his calls for the police to be able to shoot to kill. Another prominent presidential candidate, São Paulo state governor Geraldo Alckmin of the centre-right Brazilian Social Democracy Party, said Mr Lula’s Workers’ Party, the PT, was “reaping what it sowed”. Yet even as controversy over the bus attack grew, so too did another row, this time over a new series from Netflix, The Mechanism, by Brazilian director José Padilha. Loosely based on the country’s biggest corruption investigation, Operation Car Wash, it had the PT crying foul. The party’s leaders thought the series targeted them with its depiction of shady politicians. “The management of Netflix doesn’t know what it is messing in,” said former president Rousseff. But in the end, reality returned to steal the limelight with the release from jail of the country’s most notorious corrupt politician, Paulo Maluf. After spending just a couple of months in prison following a lifetime of corruption cases, the supreme court ruled the 86-year-old congressman could be placed under house arrest – just in time to celebrate Easter with his family. It seems that despite the drama over Car Wash, impunity is far from over in Brazil.

The Brazilian Society seems to be returning to the streets in disgust, outraged by the Supreme Federal Court (STF)'s decision to accept an unlawful habeas corpus ruling against former President Lula, who has been convicted in a second instance and should have been arrested. Convocations of the civil movements are being made all over Brazil. The Movimento Avança Brasil (MAB) informs that 110 cities have already confirmed street movements on 03/04, one day before the judgment scheduled for the next day by the STF, and the presence in Av. Paulista should be gigantic.

In Curitiba, the demonstrations of 03/04 were divided in two fronts, one in “Boca Maldita” (traditional sidewalk of political and cultural manifestations), with the participation of several movements, while another front, led by Vem Pra Rua, will be ahead of the Federal Justice building.

In Brasília, movements such as Rua Brasil, Bloco Movimento Brasil, among others, along with movement leaders from various parts of the country, are organizing for 04/04, to demonstrate before the STF. The Governor of the Federal District, a partisan of the already condemned former president, has been denounced by activists, such as journalist Elisa Robson via Facebook. In the Convergences, its Coordinator Thomas Korontai, suggested to the several lawyers that work there, to enter with a judicial order (Mandado de Segurança), to guarantee the free exercise of the expression, being incumbent on the governor, to highlight the policing for maintenance of the order, considering that it is likely the presence of activists paid by the class that assaulted the coffers of Brazil.

Membros do Ministério Público e da magistratura de todo o país vão entregar um pedido oficial pela prisão em 2ª instância aos 11 ministros do Supremo Tribunal Federal (STF) na segunda-feira, antevéspera do julgamento do habeas corpus preventivo do ex-presidente Lula, condenado a 12 anos e um mês no caso tríplex. Na quarta-feira, 4, os ministros analisam o mérito do pedido do petista para aguardar em liberdade os recursos contra a condenação na Operação Lava Jato.

Na manhã desta sexta-feira, mais de 330 promotores, procuradores e juízes já haviam assinado a nota técnica. “Nada justifica que o STF revise o que vem decidindo no sentido de que juridicamente adequado à Constituição da República o início do cumprimento da sanção penal a partir da decisão condenatória de 2ª instância. A mudança da jurisprudência, nesse caso, implicará a liberação de inúmeros condenados, seja por crimes de corrupção, seja por delitos violentos, tais como estupro, roubo, homicídio etc.”, afirma o documento.

LONDRES - Usando a expressão em português, o site do jornal britânico Financial Times perguntou se finalmente é "tchau, querido" para o ex-presidente brasileiro Luiz Inácio Lula da Silva. Em sua página na internet, o jornal britânico diz que a verdade tem competido com ficção na política brasileira, mas a primeira saiu vitoriosa, e a potencial desqualificação do ex-metalúrgico para concorrer à eleição presidencial "revela o vácuo de liderança que está no coração da política do País".

A publicação conta que, na parte real do drama, um ônibus da caravana de Lula foi baleado enquanto o líder populista viajava pelo Sul do Brasil, deixando buracos de bala, mas não vítimas. Ainda não foram identificados culpados no ataque. O petista vem como o mais forte esquerdista, com 36% das intenções de voto nas eleições de outubro - o dobro de seu rival mais próximo - e estava em campanha na região em uma última tentativa de aumentar o apoio público antes de um julgamento crítico na próxima semana.

Conforme o FT, Lula já tem "praticamente um pé na cadeia" depois de ser condenado por corrupção por receber favores de uma construtora. De acordo com a lei brasileira, uma vez que uma condenação é confirmada por um tribunal de apelação, um criminoso deve apresentar quaisquer recursos adicionais aos tribunais superiores a partir do "conforto" de sua cela de prisão. Tendo esgotado todos os caminhos possíveis no tribunal de apelações, a última esperança de Lula é um pedido de habeas corpus ao Supremo Tribunal Federal (STF), medida que permitiria que ele permanecesse livre, aguardando novas apelações.

O STF deverá ouvir seu caso na próxima semana. Se decidir contra ele, pode ser "tchau, querido" para o político mais conhecido do Brasil, afirma o FT, explicando que a expressão se trata de uma marca de sua protegida, a ex-presidente Dilma Rousseff, que se tornou um lema para os políticos da oposição.

O tiroteio aumentou o calor do que já promete ser uma eleição divisória. O site destaca que o candidato da extrema direita, Jair Bolsonaro, chegando na mesma região do comboio de ônibus, reiterou seus pedidos para que a polícia possa atirar para matar. Outro proeminente candidato presidencial, o governador do Estado de São Paulo, Geraldo Alckmin, do PSDB, de centro-direita, disse que o Partido dos Trabalhadores está "colhendo o que plantou".

No entanto, mesmo com o aumento da controvérsia sobre o ataque ao ônibus, o mesmo aconteceu com outra linha, desta vez sobre uma nova série da Netflix, O Mecanismo, do diretor brasileiro José Padilha. A DPU DEFENDE, EM NOTA, O VOTO IMPRESSO, COMO FORMA DE SE TER CONTRAPROVA FÍSICA DE CADA VOTO. A Defensoria Pública da União protocolou petição para participar como litisconsorte ativo na Ação Direta de Inconstitucionalidade proposta pela PGR ao STF, com finalidade de suspender a validade da Lei 59-A que trata da Lei do Voto Impresso. O Instituto Resgata Brasil (IRgB) dirigido pelas advogadas Bia (Beatriz) Kicis e Cláudia Castro já foi aceito como amicus curiae. A nota e a matéria podem ser conhecidas aqui.
